Acceptable Use Policy

1. Who this policy applies to

MLE Software LLC, doing business as Accolade ("Accolade," "we," "us"), provides software for property owners and managers ("Customers") and the people they serve. This policy applies to everyone who accesses or uses any of the following ("Services"):
  • •
    the Accolade platform, including its leasing, maintenance, vendor, resident, call-center, field, and AI features;
  • •
    the Accolade resident app and web portal, the technician app, and the leasing-agent app;
  • •
    the applicant identity-verification flow;
  • •
    APIs, event streams, file exchanges, and other integrations we provide;
  • •
    the demonstration environment at demo.accoladehq.com; and
  • •
    the website at accoladehq.com.
That includes Customers; the employees, contractors, and agents a Customer allows to use the Services ("Authorized Users"); residents, applicants, and prospects who use resident-facing features; vendors; demonstration users; and website visitors. We call all of them "you". By using the Services, you agree to this policy.

2. How this policy relates to your agreements

This policy is part of every agreement that gives you access to the Services: a Customer's subscription agreement and order form, the resident app terms, vendor enrollment terms, the demonstration-environment terms, and any other terms we post. Where you have a signed agreement with us, the order of precedence is that the signed agreement governs any direct conflict with this policy, and this policy governs everything the agreement does not address. For text messages, the Text Messaging Terms govern how messages are sent and stopped, and this policy governs conduct. Our Privacy Policy and the Customer's privacy notice explain how information is handled; they are not changed by this policy.
A Customer's violation of this policy is a material breach of its agreement with us.

3. Permitted use

Use the Services only for lawful purposes, within the scope your agreement or your role allows, and in a way that respects other users, residents, and the communities the Services support. Customers may use the Services to operate their own properties. Residents, applicants, and vendors may use the features made available to them for their own housing, application, or vendor relationship.

4. What you may not do

Law and the rights of others. Do not use the Services to:
  • •
    break any law, including fair housing, consumer protection, privacy, telemarketing, debt collection, and data-security laws;
  • •
    infringe or misappropriate anyone's intellectual property, privacy, or publicity rights; or
  • •
    harass, threaten, defame, or discriminate against anyone.
Access and security. Do not:
  • •
    access an account, data, or feature you are not authorized to use, or share or sell your credentials;
  • •
    probe, scan, or test the vulnerability of the Services or bypass any security or access control, except as Section 7 allows;
  • •
    upload or transmit malware, or anything designed to disrupt or gain unauthorized access; or
  • •
    enter real resident, applicant, financial, health, or payment-card data into the demonstration environment.
Interference and automation. Do not:
  • •
    scrape, crawl, harvest, or bulk-export content or personal information from the Services, or run bots, scripts, headless browsers, or autonomous agents against the Services, unless we have authorized it in writing or through a published API;
  • •
    send spam, bulk unsolicited messages, or messages to people who have opted out, through any Accolade channel;
  • •
    overload, disrupt, or degrade the Services or the networks that carry them; or
  • •
    frame, mirror, or embed the Services, or remove any proprietary notice.
Intellectual property and competition. Do not:
  • •
    copy, modify, translate, or create derivative works of the Services, or reverse engineer, decompile, or try to extract source code, models, prompts, weights, or training data, except where the law gives you a right that cannot be waived;
  • •
    resell, sublicense, rent, or share access to the Services, or offer them to third parties as a service bureau;
  • •
    use the Services, their outputs, or any data obtained from them to build, train, fine-tune, or improve a competing product or any machine-learning model; or
  • •
    publish benchmarks or performance comparisons of the Services without our written consent.
Content and conduct. Do not post, send, or generate through the Services anything that is:
  • •
    illegal, fraudulent, deceptive, or intended to impersonate a person or organization;
  • •
    sexually explicit, exploitative of a minor, or graphically violent;
  • •
    hateful, or that incites violence or harm; or
  • •
    an advertisement for an unrelated business, unless the feature is designed for it.
Fair housing. Do not use the Services to:
  • •
    steer, screen, advertise, price, or communicate in a way that treats people differently because of race, color, religion, national origin, sex, familial status, disability, source of income, or any other characteristic protected by federal, state, or local law;
  • •
    discourage or refuse a reasonable accommodation or modification request, or route such requests only to an automated channel; or
  • •
    make or threaten any housing decision in retaliation for a complaint.

5. AI features

The Services include AI features that draft messages, answer questions, summarize calls, and help staff work. When you use them:
  • •
    A person decides. Do not use an AI output as the sole basis for approving, denying, ranking, or pricing a rental application, renewing or ending a tenancy, starting an eviction, deciding a deposit or fee, or making any other decision that affects a person's housing, credit, employment, insurance, or access to services. A qualified person who can change the outcome must review and make the decision.
  • •
    Tell people AI was used. Where an AI output informs a decision about a specific person, tell that person that AI was used. Keep every consumer-facing AI agent configured to identify itself as automated at the start of a conversation or in the interface, and never configure one to claim to be human.
  • •
    Check the facts. AI outputs can be wrong. Verify factual statements before you rely on them or send them to a resident, applicant, vendor, or regulator.
  • •
    Respect the safety limits. Do not prompt or configure an AI feature to produce content that Section 4 prohibits, to work around its safety controls, or to remove watermarks or provenance information from its outputs.
  • •
    Do not train on it. Do not use AI outputs, prompts, or platform data to train or improve another model or AI system.
We configure the AI features to follow our model providers' usage policies, and we may decline a request or change a feature to stay within them.

6. Content you post or upload

Residents, vendors, and staff can upload photographs, documents, listings, messages, and other content. You are responsible for content you provide and for having the right to share it. By posting content, you allow us to store, display, and transmit it to run the Services. We do not review content before it is posted, but we may remove content that violates this policy or the law.

7. Security research and reporting

If you find a security vulnerability in the Services, report it to security@accoladehq.com and give us a reasonable time to fix it before you disclose it. We will not pursue a claim under this policy or the anti-circumvention laws against research that is done in good faith, that does not access, change, or destroy other people's data, that does not disrupt the Services, and that follows this section. Testing that goes beyond that is not authorized.

8. Monitoring

We may monitor use of the Services to operate and secure them, to enforce this policy, and to comply with law, using automated tools and limited human review. We do not use monitoring to make housing decisions about anyone.

9. What happens if you violate this policy

If we reasonably determine that you have violated this policy, we will act proportionately:
  • •
    We will tell you what we found and give you a reasonable time to cure it, where that is practicable.
  • •
    We may immediately and narrowly limit or suspend the affected account, feature, or content, with notice as soon as practicable afterward, where the violation creates an urgent risk to security, to people, to data, or of unlawful conduct.
  • •
    We restore access once the violation is cured, and we may terminate access for an uncured material violation under the terms of the agreement that governs your access.
  • •
    We may remove content, preserve evidence, and report unlawful activity to authorities.
Taking no action in one case does not waive our right to act in another.

10. Your responsibility for your account and your users

Customers are responsible for everything done through their accounts and by their Authorized Users, for keeping credentials confidential, and for telling their users about this policy. If you learn of unauthorized use of your account or of a violation by one of your users, tell us promptly at the contact in Section 12.

11. Resolving disputes

If you have a signed agreement with Accolade, its dispute-resolution terms apply to any dispute about this policy. For everyone else, any dispute with Accolade about this policy or the Services will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, under the Federal Arbitration Act, in New York, New York, or by video, applying Delaware law. Claims may be brought only individually and not in a class, collective, or representative proceeding, and you and we waive a jury trial for any claim that goes to court. Either of us may use small-claims court instead. You may opt out of arbitration by emailing legal@accoladehq.com within 30 days after you first use the Services, with your name and a statement that you opt out.

12. Changes and contact

We may change this policy by posting a new version with a new effective date. If a change narrows what you may do, we will notify Customers and give notice in the Services before it takes effect.
