Fair Credit Reporting Act

Definition

The Fair Credit Reporting Act (FCRA) is a federal law that governs how consumer report information is collected, shared, used, and corrected. In multifamily housing, tenant screening reports and certain rent-payment reporting activities can fall under the FCRA. The law requires reasonable procedures around accuracy, confidentiality, relevance, proper use, and consumer dispute handling.

Example

A property management team uses a tenant background report to evaluate an applicant’s rental application. Because that report is a consumer report, the team must have a permissible purpose to obtain it and follow FCRA requirements when using it in the leasing decision.

Why it matters

FCRA compliance affects resident screening, lease-renewal decisions, and rent-payment reporting programs. Operations leaders need clear policies for data accuracy, dispute reinvestigation, staff training, and service-provider oversight because errors can create legal exposure and harm applicants or residents.
