Fair housing

Plain-language definition of fair housing and why it matters for multifamily leasing, screening, policies, and compliance.

Definition

Fair housing means providing equal access to housing and housing-related services without discrimination. Under the Fair Housing Act, protected categories include race, color, religion, sex, national origin, disability, and familial status. For multifamily operators, fair housing also means watching for neutral-looking policies that could still have a discriminatory effect.

Example

A multifamily operator updates its applicant screening policy and applies the same written criteria at every property. Before rollout, the team reviews whether any criterion—such as criminal history, income rules, or automated screening inputs—could unfairly screen out people in a protected class and documents the business reason for each requirement.

Why it matters

Fair housing affects daily decisions in leasing, marketing, resident screening, accommodations, renewals, and enforcement of community rules. Operations leaders need consistent, documented processes because HUD, DOJ, and private litigants can challenge housing practices that discriminate intentionally or create a discriminatory effect.
